ABOUT THE OFFICE OF PUBLIC TRUSTEE

The Office of Public Trustee is not like a conventional government agency, but is a corporation established by the Public Curator Act Chapter 81 (Principal Act) and Public Curator (Amendment Act 2020). It has perpetual succession and can hold, acquire and dispose properties and assets, and can sue and be sued on its own corporate name and style.

The process involved in the appointment, suspension and dismissal of Public Trustee as your Office is very well aware of which is in accordance with the Regulatory Statutory Authorities (Appointment to Certain Officers) Act 2004.

The Office is the legal custodian of all deceased matters in this jurisdiction by virtue of law through its initial vesting powers under Section 14 and 15 of the Public Curator Act Chapter 81 (PCA) and Section 44 of the Wills, Probate & Administration Act (WPA), as well as by virtue of grant of Probate OR Letters of Administration from the National Court, based on Sections 10, 11 and 12 of the PCA.
